Legal VS Illegal
A well-finished basement doesn’t automatically make it a legal suite. To be compliant, it must meet municipal zoning, permitting, and building code requirements that regulate how the space is designed and approved. Bedrooms & Egress
Each bedroom must include a code-compliant egress window that meets municipal size and access requirements for emergency exit.
Dedicated Bathroom
A legal suite requires its own full bathroom, complete with toilet, sink, and a tub or shower.
Independent Cooking Area
The suite must have separate cooking facilities, typically a kitchenette with its own stove and oven, fully independent from the main home.
Private Exterior Access
A separate entrance from outside is required. A shared stairwell is acceptable if the suite has its own private door.
Independent Heating
The suite must operate on its own heating system to function independently from the main residence.
Fire Protection
Hardwired, interconnected smoke and carbon monoxide alarms are required between the suite and the main home to meet fire safety codes.
Sound Separation
Code-compliant soundproofing is required between units to reduce noise transfer and improve livability.
Utilities & Electrical
Electrical panels may be shared, but circuits cannot be. The suite must function independently without shared loads.
Inspections & Approval
All work must pass required electrical, plumbing, HVAC, and building inspections to receive final municipal approval.
